Terry Fitzgerald and Glen Williams are pleased to advise that we have successfully appealed the governing body (MNZ) on a claimed infringement of machine specification which affected points gained at the manfield round of the NZ National road race championship in February this year.
The appeal was upheld and the original decision overturned. All lost championship points were reinstated and no penalty exists.
Terry and Glen would like to thank all of their supporters and expert witnesses that assisted in making this a successful appeal and also thank MNZ
for conducting a fair and constructive enquiry into this matter.
Both the riders are looking forward to moving onto next years championship with a clear conscience and a newly invigorated commitment !
Glen comments "The whole appeal system has actually been a very interesting process to go through - and both Terry and myself have learnt a lot of how MNZ handles due diligence and applies its own guidelines. They have been willing to listen and make changes where needed - and we feel that justice has been given a chance"
The machine technical issue under question involved whether the removable air intake tube that makes up part of the air cleaner assembly is in fact the "airbox". As the rules for a 650cc four valve twin cylinder machine in the formula 3 class calls for a standard "airbox" and "air filter" to be retained . Both Terry & Glen argued successfully that the word airbox means just the box that forms the air chamber and that the various other parts attached to the airbox which have completely separate part numbers are in fact not the airbox. We are glad to have cleared up this confusion.
Glen says the standard airbox and air filter has always been used on his and Terry's machine and is therefore has and is completely legal and within the rules as they are currently.
"We are really looking forward to doing battle with some new machines next year and we hear on the grapevine that a few new 450cc triples cylinder machines may come into the championship and of course the trick Aprilia Tigcraft of Foxton based Jason Easton's will be back"
